Rhode Island has made history with the appointment of Melissa DuBose as the first Black, out LGBTQ+ judge on the US District Court. This milestone represents a significant achievement for diversity and inclusion in the state’s legal community. DuBose was sworn in on January 3, 2024, during a private ceremony at the federal courthouse in Providence. Her appointment marks a new chapter in her career, bringing her years of legal experience and commitment to justice to the bench.
DuBose’s Path to the Bench
Judge DuBose was nominated by President Joe Biden in January 2023 to fill the vacancy left by Judge William E. Smith, who took senior status at the start of the year. After a thorough confirmation process, DuBose’s nomination was approved by the U.S. Senate in March 2024. Her commission to serve as a US District Court judge was officially granted on January 2, 2024.
Chief Judge John J. McConnell Jr. expressed his excitement, stating, “It is my great honour to welcome Judge DuBose to the federal bench. Her extensive experience, dedication to justice, and commitment to fairness will be invaluable to our court and the legal community.”
From Teacher to Advocate
Before her legal career, DuBose worked as a teacher in Providence public schools for over a decade. Her decision to transition into law came after a pivotal moment in her teaching career. One of her students was involved in a tragic incident, being charged with the murder of another teenager. This event led DuBose to reflect on the criminal justice system and her ability to address her students’ questions.
“I felt really kind of helpless at that point,” DuBose shared with The Boston Globe. “That was the moment where for me, it was, ‘I need to do something else to be able to be an advocate for my students in a way where they are getting good information.’”

With a background in education, DuBose brings a unique perspective to her role as a judge. She is dedicated to ensuring fairness in the courtroom and upholding the principles of justice.
